Customer Underground Tank Agreement

Propane Plus would like to thank you for allowing us to provide you with an underground propane tank. These tanks are similar to above-ground tanks, with one difference: they are installed underground. This can sometimes cause later confusion as to the ownership of the underground tank. To help to eliminate any such confusion, Propane Plus asks you to read this agreement and then sign it and return it to us.

Propane Plus will install or has installed an underground propane tank at your location. As long as at least the capacity of the tank is used annually, there is no charge for you to utilize our tank. This means, for example, that if you have a SOO-gallon tank, you must use 500 gallons per year, and ifthe minimum is not met, Propane Plus reserves the right to charge a minimum use fee. Using at least one tankful annually is seldom a problem.

Underground tanks require some maintenance, so Propane Plus will conduct an annual inspection ofthe valves and anode bag(s). If anything doesn't meet industry standards, Propane Plus will rectify the situation at no cost to you. If the tank needs replacing at any time, we will replace the tank at no cost to you, and will do our best to swap the tank with minimal damage to surrounding areas. We will do our best to leave the site neat and clean, but we are not responsible for landscaping (grass seed, trees, irrigation, etc.). It is very rare that an underground tank requires digging up, but sometimes it is necessary.

If for any reason you ever decide to cease doing business with us and you would like to change suppliers, you have a few options.

1. You can have your new supplier bring us a new tank, anode bag( s), and regulators, and we will swap ownership ofthe tank in your yard.
2. You can buy the tank at its replacement cost to us.
3. Propane Plus will dig up the tank and fill in the hole at no cost to you.

In signing this statement, you give us irrevocable permission to enter your property and dig up the tank and fill in the area where it was installed if you choose to change providers, or if you are delinquent by more than six months in your payments to us. We do not anticipate having to exercise these options, but it is important that you understand that Propane Plus owns the underground tank and associated equipment that we have installed at your request, and that we reserve our right to reclaim it if necessary.
